  1. As stipulated under Paragraph 2, Article 68 of the Social Order Maintenance Act, those resorting to harassing occupants, factories, companies and businesses, public venues or venues accessible to the general public are punishable by detention of up to three days or a penalty of up to NT$12,000.  Of which, the term “resorting to harass” refers to resorting to false pretense by deploying external inappropriate means to cause subjective, direct harm to the legal gains or living gains that exist as a fact.  The reference of receiving harassment phone calls, when starting to affect a person’s normal daily work, said telephone caller’s conduct has constituted as the penal critical element of obstructing the Social Order Maintenance Law, and can be tipped off by presenting relevant data to the jurisdictional police institution per stipulations set forth under article 39 of said law, whereby the police institution is to investigate and refer the case to the court (the summary court) for rendering a judgment, as required by law.

Also the Directorate General of Telecommunications, Ministry of Transportation and Communications has since June 24, 2005 announced and inducted the “Telecommunication Enterprise Subscriber Inquiring Telecommunication Communicating Records Inquiry Measures”, and members of the public may pay the fee to inquire in person with the telecommunication company for whose own two-way communicating record data.
