Regarding the matter of deformation with handset short-messaging, as stipulated by Article 310 of Taiwan’s Criminal Code, “Those attempting to spread information to the general public to accuse or spread matters that suffice to damage the reputation of others constitute as the libel crime”, where the term attempting to spread information to the general public is hinged on the probability in enabling unspecified individual to see and witness it, and that the matters spread are of matters shamed or detested by the general public of the society and suffices to cause harm to others’ charter.  If a message sender has indeed acted to spread information to the general public or forward the information, it would constitute as the constituting critical elements the article specifies, and please also present tangible material evidence (such as the content of the deformation or the fact of spreading it) and call on a nearby police institution to report the case, complete with producing a deposition, to complete the case reporting procedure to facilitate subsequent investigation and processing.
